Title of Bill: The Patriot Act Rescission Bill of 2006
BE IT ENACTED BY THE CONGRESS OF THE UNITED STATES
Whereas the United States Constitution is founded upon the principle of
natural law (God's law) and the concept of inalienable rights is an
inseparable part of the United States Constitution and its Bill of Rights; and
Whereas the United States Constitution and its Bill of Rights recognizes
and guarantees the people of the United States of America protection of those
inalienable rights, which include, but are not limited to: freedom of
religion, speech, assembly and privacy; protection from unreasonable search
and seizure; due process and equal protection of the law for any person;
equality before the law and the presumption of innocence; access to counsel in
judicial proceedings; a fair, speedy, and public trial by an impartial jury;
and
Whereas the people are the true sovereigns of the nation as the creators of
government and the grantors and limiters of its powers and the United States
Constitution is the supreme law of the land; and
Whereas the founding fathers warned against legislators who undertake to
pass laws which violate natural law thereby violating God's law or inalienable
rights; and
Whereas Congress has no right to infringe upon those rights protected by
the United States Constitution and its Bill of Rights; and.
Whereas Public Law 107-56, H.R. 3162, commonly known as the USA PATRIOT Act
was passed without due study and debate; and
Whereas the USA PATRIOT Act infringes upon those protected inalienable and
fundamental rights of the people as stated in the United States Constitution
and its Bill of Rights by enabling an abuse of power, a breach of the public
trust, misappropriation of public resources, distortion of the Separation of
Powers, and a violation of civil rights; and
Whereas, there is no inherent conflict between national security and the
preservation of liberty and that Americans can be both safe and free; and
Whereas over 400 cities, towns, counties, and states have enacted
resolutions protesting the loss of rights by virtue of the USA PATRIOT Act;
and
Whereas 'All laws which are repugnant to the Constitution are null and
void.' (Marbury vs. Madison); and
Whereas 'An unconstitutional act is not law; it confers no rights; it
imposes no duties; affords no protection; it creates no office; it is in legal
contemplation, as inoperative as though it had never been passed.' (Norton vs.
Shelby County); now therefore,
Congress shall within 15 days following passage and Presidents signing of
this Bill, or passage over Presidential veto, rescind, nullify, and void the
USA PATRIOT Act.
