The USA PATRIOT Act became law in the frantic aftermath of
the 9-11 attacks. This act has the capability of diminishing freedoms valued
by the American people for over two hundred years. The Separation of Powers,
which is a cornerstone of our Constitutional Republic, is also threatened by
this act. The USA PATRIOT Act must be rescinded! Enclosed is a sample bill
that has some ideas you may wish to use.
Governments should protect the public from terrorist attack,
but must do so in a rational and deliberative fashion ensuring that security
measures will promote public safety without impairing constitutional rights or
infringing on civil liberties. The hysterical manner in which the USA PATRIOT
Act was passed, with most Representatives never studying the Bill, erodes
Congressional credibility.
Marbury vs Madison states that 'All laws which are repugnant
to the Constitution are null and void.' Any law that threatens rights
enumerated by The Bill of Rights is patently unconstitutional. The USA PATRIOT
Act threatens many of those cherished freedoms. The Supreme Court has stated
that an unconstitutional act is 'as inoperative as though it had never been
passed'. (Norton vs Shelby County) It is past time to excise this growth on
our Freedom by rescinding the USA PATRIOT Act.
Since its passage, the USA PATRIOT Act has drawn immense
protest from all over America. 397 cities, towns and counties, and
seven states have passed resolutions protesting the loss of rights inherent in this
act. Twenty-one other states are considering similar resolutions. Our people call for action!
Will you sponsor a bill to rescind this transfer of
legislative power to the Executive Branch? Will you use your influence to get
this law removed? Will you lead a movement of Americans, who are as concerned
for our historic freedoms as you are, to rescind this abuse of the legislative
authority? Will you serve your country and future generations, restore
freedom, and preserve the Separation of Powers? Will you rescind the USA
PATRIOT Act? I anxiously await your reply.
